UCC as an idea is great but BJP states are the one who are going against core idea of UCC by introducing anti conversion and beef ban bills. I don't think their UCC will treat all religions equal like they are claiming right now to achieve.

Yes because if UCC comes, it will be a step in the right direction. Everyone is aware of the "equal law for every religion" aspect of UCC which in and itself is a great thing. But there's another huge problem which people usually don't pay attention to that UCC will solve.

 In almost every other democratic country in the world, law accommodates religion. In our country, law bends over backward for religion. Our family laws almost never take precedence over customs and traditions. In fact, if you can prove that some practice (eg. Child marriage) that usually wouldn't be allowed by law is a valid custom, then it will be considered legal. 

If UCC is formulated and implemented in the right way and they get rid of this idea of upholding customs no matter how they harm the society, then finally law might start taking precedence over religion in our country in reality and not just on paper most of the time.

1. No beef ban - Yay. No bring in the cows, not just the buffaloes and oxen. 

2. No anti-conversion bills

3. No CAA/NRC

4. No Special Marriage Act or Hindu Act - Just simple marriages and inheritance

I agree with the UCC. Calling yourself a secular country without having it is intellectually dishonest. And saying that you conveniently redefined secular  to match your position is just a cop out.

I would support if it treats all individuals equal even lgbt people.
So UCC has to recognise same sex marriage, polygamy, female version of it and polyamory too. Also every child(by blood or adopted) should have equal share in ancestral property.

Uniform civil code should just shut eyes to existence of any religion and should not care about the beliefs and sensibilities of any religion..

I have always been a supporter of Uniform Civil Code. Rights of all citizens should be equal.

I support reservation for the wrong done in the past to dalits and lower categories to bring them on board.

However beyond all this what I support is clean water , road , electricity and decent education for all. once these there basics are met rest will fall in place. Education itself will eradicate the evils and bring society on equal platform.

But the govt is only involved in dumbfuckery and not keen on anything beyond helping vested interests

It should apply to everyone and not just for certain communities. 

So this means for example Hindus shouldn't be crying about how other communities are eating beef (which they have been doing for millennia) and they gave to stop lynching and murdering people who have stolen cows or eaten cows. These kind of things don't happen in civilized cultures.

Idea is great. But our government has lot of experience in fucking us up with good ideas. 

Still I doubt it will ever happen. Its interpretations have also been very complicated.  E.g. On polygamy, will all people get equal opportunity / freedom of marriage, or all will get equal freedom to practice their religion in its originality? 

Its not that black and white. A cunning lawyer will tell you the scope of misuse of UCC too. 

Unless its more clear what exactly is UCC, very hard to stand with, or against, UCC.

I will probably be the counter argument here and say no.

UCC really varies as a law depending on how that Civil Code is defined. Uniformity can easily kill diversity. I also think it will kill our diverse culture (a lot of which is problematic and needs to go).

From what I've read the idea is to bring down legal advantages which some group has as a special marriage act etc etc. Instead why not just abolish those acts and laws? 

India is too huge to be uniform, unless you want to ho the China way. The federal structure might also be weakened by it.

For a country like India, I don't. Without a uniform civil code itself the dominant culture keeps chipping away at minorities(bjp or otherwise). Anyone who executes it will only push dominant " Indian kulcha" .

We're waaay too diverse for something like this and as bad as bjp is it's not like previous governments were significantly better. I make no distinction between hindutva and Hinduism, they oppress equally and a civil code will magnify this.

I'm all for it but I think BJP are gonna use it as an opportunity to divide people further.

I support the Law commission of India's view: Equality is more important than uniformity. We don't need to have the same civil laws for everyone but we do need to eliminate all parts of all religious laws that are discriminatory.

I have only peripherally paid attention to it, and I have liked the sound of it. BUT.

I want it to support a marriage as a recognized relationship between any consenting individuals of legal age (although legal age may run into problems, I'm not getting into that), irrespective of gender or sexuality. Also LGBT+ people should get right to adopt children.

I want it legal that women do not have to change their names after the marriage and me *can* change it if they so desire. Amount of times women get asked for 'married name' documents... My aunt was refused a lone just after her wedding because the name wasn't changed yet.

Yes, you are right. But Muslims don't want it to be removed. Muslims don't want UCC. The majority of Muslim votes go to the secular parties. Hence, you won't find secular parties asking for UCC.

It's backed BJP because UCC changes will mainly affect Muslims, so their Hindutva support base will be happy. 

Ideally, all parties should support UCC.

Because India is a "Secular" republic, the republic has left the civil society to choose the civil law they're willing to live under. Citizens get to choose if they're going to follow the rituals, rules, customs or laws passed based on their religious beliefs or they're free to choose to use non religious civil laws like the special marriage act.


For maintenance there's CrPC section 125, (don't know what it's now under BNSS)

I know quite a few progressive Tamil Muslims who recognise that the Muslim personal law needs reform and would even support UCC, but they believe that it would be impossible for BJP to constitute a truly secular UCC as they are not a secular party. And if this UCC is truly blind to religion, it should extend reservation to socially marginalised Muslims (though this wouldn’t affect TN as we don’t have SC Muslims like in the north). 

And to reply to some of OP’s stuff; 

Waqf laws are sometimes vague as it has taken centuries to reach its current form and governs property donated from centuries ago before we had a modern state, bureaucracy and paperwork and has many provisions based on archaic traditions. How would you prove paperwork for a property that is a thousand years old with the original documents turning to literal dust. It desperately needed reform but the waqf bill is dangerous. No law mandates that Hindu, Sikh or Christian religious welfare trusts must have at least 2 non-Hindus, non-Sikhs or non-Christians members in their governing boards, but Muslims must now have two non Muslims appointed by the state in their governing authorities. It now enable for the majority of the waqf board to be non-Muslims appointed by the state government (pls check PRS legislative research for more info). I predict a lot of contested waqf land in BJP states will now be arbitrarily declared as null and be sold off to make local politicians and corrupt businessmen rich.

How is repeating Talaq in spaced intervals different from triple talaq? The triple talaq loophole is solved and there’s no need to discuss that. 

Inheritance in Islam makes sense when you see the whole picture. In Islam, a man has to pay dowry to his fiancé in the form of money or property to get married. Hence the daughter gets only half the inheritance compared to the son. This is because there is an assumption that the son will need the larger inheritance to pay the dowry for his future wife, and the smaller inheritance of the daughter will be compensated by the dowry her future husband will pay her.

UCC will have exceptions for Hindus while being strict on all other religions. We have seen this picture so many times. 

UCC also proposes to exclude tribals, so what's the point. Over time, many more exemptions would be added. 

I'm not even going into the part where, states like Uttarakhand, have used UCC to look into the privatey lives of citizens

Special Marriage Act is for people from two different religion. You are going for Marriage through Court Registration, Don't require Wedding Card etc.

Just require you to fill an application with Photograph, PAN or Aadhaar Or Passport for Age &amp; Address Proof, Two Witness With their Aadhaar. Ideally if your Parents are witness, then nothing like it.

Once application is filed in the Court, Waiting Period of 30 days, for somebody to file objection.

Then appear in the Court with your witness, Sign the Register in front of Registrar. Bingo, You are married.

Best to use a Lawyer.

They will charge Rs 5000 to 6000 inclusive of everything.

You will get Computer Generated Marriage Certificate.

So if I remember correctly, seven documents are required -

1. Marriage registration form (filled by both parties)
2. Passport size photographs (separate)
3. Passport size photograph (Marriage ritual) 
4. Matriculation certificate for D.O.B.
5. Aadhar or other residential proof. 
6. One copy of wedding invitation card. 
7. Two witnesses along with aadhar card. 

And a gazetted officer or civil surgeon to identify both of you.

whatever i know from reading up online or movies, even in other countries and christian weddings, you're required to have a 3rd person with you  to be a witness. christian marriages go as far to allow people to object. isn't it something similar ?
